Please read these Terms of Service (“Terms” or “Agreement”) carefully before using the Office Dead Pool website located at officedeadpool.com (the “Site”), operated by Office Dead Pool (“ODP,” “we,” “us,” or “our”). By accessing or using the Site, you agree to be bound by these Terms. If you do not agree to all of the terms and conditions of this Agreement, you must not access or use the Site.

1. Acceptance of Terms

By creating an account on, accessing, or otherwise using the Site, you acknowledge that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy, which is incorporated herein by reference. We reserve the right to modify these Terms at any time, and such modifications shall be effective immediately upon posting on the Site. Your continued use of the Site following any modification constitutes your acceptance of the modified Terms.

2. Eligibility

The Site is intended for use by individuals who are at least 18 years of age. By creating an account or using the Site, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into this Agreement. If you are under 18 years of age, you are prohibited from using the Site.

3. Description of Service

The Office Dead Pool is a humorous, entertainment-only prediction game in which users predict when coworkers or colleagues may voluntarily or involuntarily depart from their place of employment. The Site allows users to make predictions, submit nominations, cast votes, share rumors, and earn points based on the accuracy of their predictions.

Entertainment Disclaimer. The Site and all of its features are intended solely for entertainment and amusement purposes. The Office Dead Pool is not a gambling service, employment advisory service, or human resources tool. No predictions, nominations, votes, rumors, or other content on the Site should be construed as having any real-world consequences, as reflecting the views or intentions of any employer, or as constituting advice of any kind. Participation in the Office Dead Pool does not create any employment, contractual, or fiduciary relationship between users, between users and their employers, or between users and ODP.

4. Account Responsibilities

To access certain features of the Site, you must create an account by providing a username, email address, and password. You agree to:

  • Provide accurate and complete registration information
  • Maintain the security and confidentiality of your login credentials
  • Accept responsibility for all activities that occur under your account
  • Notify us immediately at TheOutpost@OfficeDeadPool.com if you become aware of any unauthorized use of your account or any other breach of security

We are not liable for any loss or damage arising from your failure to protect your account credentials.

5. User Content

The Site allows you to submit content, including but not limited to predictions, nominations, rumors, votes, and associated text (“User Content”). You are solely responsible for all User Content that you submit, post, or otherwise make available through the Site.

By submitting User Content, you represent and warrant that:

  • You own or have the necessary rights to submit such content
  • Your content does not infringe upon the intellectual property rights, privacy rights, or any other rights of any third party
  • Your content is not defamatory, libelous, harassing, threatening, abusive, hateful, obscene, or otherwise objectionable or unlawful

You grant ODP a non-exclusive, royalty-free, worldwide license to use, display, reproduce, and distribute your User Content solely in connection with operating and providing the Site.

Content Moderation. We reserve the right, but have no obligation, to monitor, review, edit, or remove any User Content at our sole discretion and without notice. We may suspend or terminate the account of any user who violates these Terms or whose content we deem inappropriate, without prior notice or liability.

6. Intellectual Property

The Office Dead Pool name, trademark, logo, site design, text, graphics, and all other content provided by ODP (excluding User Content) are the intellectual property of Office Dead Pool and are protected by applicable trademark, copyright, and other intellectual property laws. You may not reproduce, distribute, modify, create derivative works of, publicly display, or otherwise exploit any of our intellectual property without our prior written consent.

7. Prohibited Conduct

In using the Site, you agree not to:

  • Use the Site for any unlawful purpose or in violation of any applicable laws or regulations
  • Harass, bully, intimidate, or threaten any person, whether or not they are a user of the Site
  • Submit false, misleading, or deceptive content with the intent to harm
  • Attempt to gain unauthorized access to other user accounts, computer systems, or networks connected to the Site
  • Use automated means (bots, scrapers, crawlers) to access or collect data from the Site without our written permission
  • Interfere with or disrupt the integrity or performance of the Site or its related systems
  • Impersonate any person or entity or misrepresent your affiliation with any person or entity

8. Disclaimers

THE SITE AND ALL CONTENT, FEATURES, AND SERVICES PROVIDED THROUGH THE SITE ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. WE MAKE NO WARRANTIES OR REPRESENTATIONS REGARDING THE ACCURACY, RELIABILITY, OR COMPLETENESS OF ANY CONTENT ON THE SITE, INCLUDING USER CONTENT.

9. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL OFFICE DEAD POOL, ITS OPERATORS, OWNERS, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR ACCESS TO OR USE OF (OR INABILITY TO ACCESS OR USE) THE SITE, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STATUTE, OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SITE OR THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU HAVE PAID US, IF ANY, IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

10. Indemnification

You agree to indemnify, defend, and hold harmless Office Dead Pool, its operators, owners, officers, directors, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys’ fees) arising out of or in connection with: (a) your use of the Site; (b) your User Content; (c) your violation of these Terms; or (d) your violation of any rights of any third party.

11. Termination

We may, in our sole discretion, suspend or terminate your account and access to the Site at any time, with or without cause, and with or without notice. Upon termination, your right to use the Site ceases immediately. All provisions of these Terms which by their nature should survive termination shall survive, including but not limited to intellectual property provisions, disclaimers, limitations of liability, and indemnification.

You may terminate your account at any time by contacting us at TheOutpost@OfficeDeadPool.com. Upon account termination, your personal data will be handled in accordance with our Privacy Policy.

12. Dispute Resolution

Any dispute, controversy, or claim arising out of or relating to these Terms or the Site shall first be attempted to be resolved through informal negotiation. You agree to contact us at TheOutpost@OfficeDeadPool.com with a written description of the dispute before initiating any formal proceedings. The parties shall use good faith efforts to resolve the dispute within 30 days of such notice.

If the dispute cannot be resolved through informal negotiation, either party may pursue resolution through the courts of competent jurisdiction as provided in Section 13 below.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States and the State of Illinois, without regard to its conflict of law provisions. You agree to submit to the personal and exclusive jurisdiction of the courts located within Cook County, Illinois for the resolution of any disputes arising under these Terms.

14. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it valid and enforceable, or if modification is not possible, shall be severed from these Terms. The invalidity or unenforceability of any provision shall not affect the validity or enforceability of the remaining provisions.

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Office Dead Pool with respect to the Site and supersede all prior or contemporaneous communications, agreements, and understandings, whether oral or written, regarding the subject matter hereof.
